By using Talivio Fit ("the Service") you agree to these Terms. Please read carefully.

1. Parties

  • Service provider: Talivio OÜ ("Talivio", "we")

2. Description of the service

Talivio Fit is a mobile health and lifestyle app that lets users:

  • Track nutrition with AI-powered meal recognition
  • Receive personalised workout programs
  • View daily metrics from Apple Health / Health Connect
  • Access real-coach guidance via Premium subscription

3. Not medical advice

⚠️ Important: Talivio Fit is not a medical device and does not replace medical advice.

  • AI meal recognition, calorie counts, and workout suggestions are approximate
  • If you have a chronic condition, are pregnant, or are under medical supervision, consult your doctor
  • For medical emergencies, call your local emergency number (112 in EU)
  • Don't make medical decisions based solely on Talivio Fit's outputs

4. Account

4.1. Registration

  • You must be at least 13 years old
  • You must be at least 18 to use the social module
  • Information you provide must be accurate
  • You are responsible for account security (password, device)

4.2. Suspension / termination

We may suspend or terminate your account, with or without notice, for:

  • Violation of these Terms
  • Illegal content
  • Repeated abuse reports in the social module
  • Fake account / impersonation
  • Payment fraud

4.3. Voluntary closure

You may delete your account at any time: Settings → Delete account. Data is processed per the Privacy Policy, Section 6.

5. Premium subscription

5.1. Pricing

  • Monthly: €9.99 (localised by region)
  • Yearly: €77.90 (35% discount)
  • 7-day free trial

5.2. Billing

  • Billed via Apple App Store or Google Play
  • Auto-renews — cancel via your Apple/Google account settings
  • Cancel at least 24 hours before renewal

5.3. Refunds

  • Apple/Google's standard refund policies apply
  • EU consumers have a 14-day right of withdrawal (only if the subscription has not yet been used)
  • If you've actively used the service (e.g., made AI recognitions) the right of withdrawal may not apply

5.4. Real coach matching

  • Eligibility requires Premium + 60 days of usage + 1500 score points
  • Coach assignment is at Talivio's discretion; matching is not guaranteed
  • Assigned coaches' guidance is at the level of lifestyle coaching, not medical treatment

6. AI use

  • Photos you take are processed by Google Gemini AI (meal recognition)
  • Plan generation uses an anonymised summary of your data
  • AI outputs are probabilistic — wrong answers are possible
  • You can override or reject any AI suggestion
  • Once your monthly AI budget (free €2, premium €5) is exhausted, additional recognition may need to wait

7. Community module

7.1. Code of conduct

You agree NOT to:

  • Threaten, harass, or use hate speech
  • Send sexual content or images
  • Spam or post commercial advertisements
  • Misrepresent your identity
  • Engage in interactions with users under 18 if you are an adult

7.2. Moderation

  • Content is reviewed by AI and human moderators
  • Violating content is removed; accounts may be suspended
  • Criminal content (CSAM, terrorism) is reported to authorities
  • Repeated violations result in permanent ban

7.3. Your content

  • You own what you post
  • You grant us a worldwide, royalty-free, transferable licence to display, store, and moderate it within the Service
  • When you delete your account, your content is deleted (even if previously shared)

8. Prohibited use

You may not:

  • Reverse-engineer, decompile, or attempt to extract source code
  • Use bots/scrapers to overload our API
  • Access other users' accounts without authorisation
  • Use the Service to distribute malware
  • Upload illegal content
  • Share copyrighted content without permission

9. Disclaimer

To the maximum extent permitted by law:

  • The Service is provided "as is"
  • We do not guarantee uninterrupted or error-free operation
  • We do not guarantee accuracy of AI predictions
  • We accept no liability for medical outcomes
  • We cannot guarantee third-party services (Apple, Google, Gemini)
  • Injuries arising from workouts are the user's responsibility

10. Limitation of liability

Talivio's total liability for any claim is limited to the total amount you paid Talivio in the previous 12 months. If the Service is free, maximum liability is €50.

Mandatory consumer protection laws override this limit where applicable.

11. Governing law and jurisdiction

  • Governing law: Estonian law (EU internal market rules apply)
  • Forum: Estonian courts
  • Consumer disputes: EU consumers may also use the dispute-resolution body in their country
  • EU online dispute resolution: ec.europa.eu/consumers/odr

12. Changes

  • We may update these Terms occasionally
  • For material changes:
    • An in-app notice is shown
    • 30 days' notice is given
    • You may close your account if you don't agree
  • Minor changes (typos, formatting) require no notice
